Terms of Use
These Terms of Use ("Terms") form a legal agreement between you and BAYSEM (Bayrampaşa Satranç Eğitim Merkezi), Istanbul, Türkiye ("BAYSEM", "we", "us"), governing your use of the BaySim FlightPad application and its companion software, BaySim Bridge (together, "the Software"). By downloading, installing, or using the Software, you agree to these Terms. If you do not agree, do not use the Software.
1. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use BaySim FlightPad on Apple-branded devices that you own or control, as permitted by the Usage Rules of the Apple Media Services Terms and Conditions. BaySim Bridge is licensed to you for use on your own Windows PC solely together with BaySim FlightPad.
2. What you need
BaySim FlightPad is a companion app. Full functionality requires a separate Windows PC running BaySim Bridge and Microsoft Flight Simulator on the same local network. A built-in demo mode is available without a PC.
3. Acceptable use
You agree not to:
- reverse engineer, decompile, or disassemble the Software, except to the extent this restriction is prohibited by applicable law;
- copy, redistribute, sell, rent, sublicense, or otherwise make the Software available to third parties;
- modify, interfere with, or attempt to circumvent the Software or its network protocol;
- use the Software for any unlawful purpose.
4. Intellectual property
The Software, including BaySim FlightPad, BaySim Bridge, their source code and design, and the BAYSEM name and logo, is owned by BAYSEM and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Software.
5. Simulation use only
The Software is provided for entertainment and simulation purposes only, for use with flight-simulation software. It must not be used for real-world navigation, flight planning, aviation operations, or any safety-of-life purpose. The information it displays reflects a simulated environment and may be inaccurate or delayed.
6. Trademarks and third-party disclaimer
BaySim FlightPad and BaySim Bridge are independent products and are not affiliated with, sponsored by, or endorsed by Microsoft Corporation or Asobo Studio. "Microsoft Flight Simulator" is a trademark of Microsoft Corporation. All other product names, logos, and brands are the property of their respective owners.
7. Disclaimer of warranties
The Software is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or compatible with any particular version of any flight simulator.
8. Limitation of liability
To the maximum extent permitted by applicable law, BAYSEM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits, arising out of or related to your use of, or inability to use, the Software.
9. Apple App Store terms
The following terms apply because BaySim FlightPad is distributed through the Apple App Store:
- Acknowledgement. These Terms are concluded between you and BAYSEM only, and not with Apple. BAYSEM, not Apple, is solely responsible for the Software and its content.
- Scope of license. The license granted to you is limited to a non-transferable license to use the Software on any Apple-branded products that you own or control, as set out in the Usage Rules of the Apple Media Services Terms and Conditions.
- Maintenance and support. BAYSEM is solely responsible for providing any maintenance and support services for the Software. Apple has no obligation to furnish any maintenance or support services.
- Warranty. BAYSEM is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the Software fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Software; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Software.
- Product claims. BAYSEM, not Apple, is responsible for addressing any claims relating to the Software, including but not limited to product liability claims, any claim that the Software fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
- Intellectual property claims. In the event of any third-party claim that the Software infringes that third party's intellectual property rights, BAYSEM, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must comply with any applicable third-party terms of agreement when using the Software.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you.

10. Governing law
These Terms are governed by the laws of the Republic of Türkiye, and the courts of Istanbul shall have jurisdiction, without prejudice to any mandatory consumer protections available to you under the laws of your country of residence.
11. Changes
We may update these Terms from time to time. Your continued use of the Software after the changes take effect constitutes your acceptance of the revised Terms.
